Terms and Conditions
These Terms and Conditions ("Terms") apply to all players, parents/guardians, and participants (collectively, "Participants") who enroll in or take part in any training sessions, programs, camps, trials, matches, or activities (collectively, "Programs") operated by [Vigour Football Academy] ("the Academy", "we", "us", "our").
By registering, attending, or participating in any Program, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Eligibility and Participation
1.1 Participants must meet the age, skill, and eligibility requirements specified by the Academy for each Program.
1.2 The Academy reserves the right to refuse or terminate participation where a Participant’s conduct is deemed unsafe, inappropriate, or detrimental to others or to the Academy.
1.3 Participants must follow all Academy rules, codes of conduct, and instructions given by coaches and staff at all times.
2. Health, Fitness, and Medical Responsibility
2.1 Participants confirm that they are medically and physically fit to participate in football training and related activities.
2.2 It is the responsibility of the Participant (or parent/guardian) to disclose any pre-existing medical conditions, injuries, allergies, or other health concerns prior to participation.
2.3 The Academy may administer basic first aid and seek emergency medical treatment where reasonably necessary. Any costs incurred are the responsibility of the Participant or parent/guardian.
3. Assumption of Risk
3.1 Football and related training activities involve inherent risks, including but not limited to physical injury, illness, permanent disability, or death.
3.2 By participating, Participants voluntarily assume all such risks, whether known or unknown, and agree to participate at their own risk.
4. Insurance
4.1 The Academy holds appropriate public liability and professional indemnity insurance.
4.2 Participants are also covered under applicable player insurance while training and playing with the Academy, subject to the terms and conditions of the relevant insurance policies.
4.3 Insurance coverage does not eliminate or reduce the inherent risks associated with participation in football activities.
5. Limitation of Liability
5.1 To the maximum extent permitted by law, the Academy, its directors, coaches, employees, contractors, and volunteers are not liable for any injury, loss, damage, or expense suffered by a Participant arising from or in connection with participation in any Program.
5.2 This includes, but is not limited to, personal injury, property loss or damage, economic loss, or consequential loss.
5.3 Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under applicable consumer protection or competition laws.
6. Indemnity
6.1 Participants (and parents/guardians where applicable) agree to indemnify and hold harmless the Academy and its representatives from any claims, demands, actions, or proceedings arising out of or in connection with:
Participation in the Programs;
Breach of these Terms; or
Any negligent, unlawful, or willful act or omission by the Participant.
7. Fees and Payment
7.1 All fees must be paid in full by the due date specified at registration unless otherwise agreed in writing.
7.2 Failure to pay fees may result in suspension or termination of participation.
7.3 All fees are stated in AUD unless otherwise specified.
8. Cancellation and Refund Policy
8.1 The Academy does not offer refunds for Programs once commenced.
8.2 Refunds may only be considered if ample written notice is provided prior to the commencement of the Program. "Ample notice" is defined as a minimum of [e.g. 14 days] before the Program start date.
8.3 No refunds will be provided for missed sessions due to illness, injury, personal circumstances, weather conditions, or scheduling changes.
8.4 The Academy reserves the right to cancel or reschedule sessions due to unforeseen circumstances. Where this occurs, the Academy may offer make-up sessions or credits at its discretion.
9. Code of Conduct
9.1 Participants are expected to behave respectfully toward coaches, staff, officials, teammates, opponents, and facilities.
9.2 Bullying, harassment, discrimination, abuse, or violent behavior will not be tolerated and may result in immediate removal without refund.
10. Photography and Media
10.1 The Academy may take photographs or video recordings during Programs for promotional, marketing, and educational purposes.
10.2 By participating, Participants consent to the use of such images unless written notice is provided to the Academy requesting exclusion.
11. Personal Property
11.1 Participants are responsible for their own personal belongings.
11.2 The Academy is not responsible for loss, theft, or damage to personal property brought to training, matches, or events.
12. Weather and Venue Conditions
12.1 Training and matches may proceed in varying weather conditions unless deemed unsafe by the Academy.
12.2 Decisions regarding cancellations or modifications due to weather or venue conditions are at the sole discretion of the Academy.
13. Privacy
13.1 Personal information collected by the Academy will be used for administrative, communication, and operational purposes.
13.2 Information will be handled in accordance with applicable privacy laws and will not be shared with third parties except where required by law or for insurance purposes.
14. Governing Law
14.1 These Terms are governed by the laws of [State/Territory, Australia].
14.2 Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that State or Territory.
15. Amendments
15.1 The Academy reserves the right to amend these Terms at any time.
15.2 Updated Terms will be made available on the Academy’s website or upon request, and continued participation constitutes acceptance of the updated Terms.
